Our Unconstitutional America
The American Revolution was fought in the resilience of what was of the Americas and its founding fathers. America’s birth began in a fight for our rights, our freedoms, and a fight for our voices to be heard and seen.
In our modern day America we see the world around us begin to crumble. Everyday our lives are changed by law-makers that no longer care about the voices of the people.
Overtime, America has slowly descended to the tyrannical rule it used to once resist, especially with the new Big Beautiful bill, the war on iran, ICE, Doge and all of these other policies, laws and additions– we are slowly moving into a new era of our nation;
The unconstitutional America.
The One Big Beautiful Bill Act

The One Big Beautiful Bill Act or the OBBBA for short, is a law that contains a large composition of policies into one massive bill. It contains different tax reforms, government spending changes, policy changes and some social reforms. Regardless of the name being a complete propaganda scheme to attract the average citizen, the OBBBA is the biggest scam in all of America – a great similarity to the “everyone is equal” version of America that had contained enslaved people and capitalist favoritism.
What really is the OBBBA?
The OBBBA is an Omnibus Bill, a way of packaging dozens of unrelated laws, spending regulations, and more into one bill so that law makers can vote on it all at once. This essentially creates an all or nothing choice to be made and coerces lawmakers into an ultimatum. For example, lawmakers who want funding for crucial infrastructure and public health benefits must agree to it, despite its hidden authoritarian policies in the bill’s jargon.
This is a tyrannical attempt to grab power that should not be given to certain people. Omnibus bills such as OBBBA are here to confuse the people and give way for the power hungry to gain. James Madison, the father of the constitution, has said himself in the federalists papers to promote ratifying the constitution: “It will be of little avail to the people that the laws are made by men of their own choice, if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood.”
Laws should be catered to the knowledge and benefit of the average citizen. If even those of the most educated level are puzzled around these laws and speculations, who can be certain what will be deemed acceptable later on? The OBBBA directly undermines the checks and balances made by the constitution that catered to the people and took away from tyrannical overreach. By consolidating massive spending, financial and social regulations into one massive bill, we take away from the duty of the legislative branch to deliberate honesty. This turns our democracy into a rushed game of political leverage.
We are meant to be a government of the people, for the people, by the people and tactics like the OBBBA turn lawmaking into a tool for the rich and powerful.
Please be wary, because as Madison has once said, “If they are repealed or revised before they are promulgated, or undergo such incessant changes that no man who knows what the law is today can guess what it will be tomorrow.”
ICE & Habeas Corpus

Habeas corpus; a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person’s release unless lawful grounds are shown for their detention.
What is ICE? The U.S. Immigration and Customs Enforcement, or ICE, is a “law enforcement agency [operating] under the Department of Homeland Security (DHS) [and] responsible for enforcing immigration and customs laws within the United States,” according to Ice.gov.
Sen. Bernie Sanders, the longest serving independent in Congress critiqued ICE, stating, “less than 14% of those arrested had violent criminal records, 86% did not. We have seen on our TV screens, ICE is occupying and terrorizing American cities, rounding up American citizens and asylum seekers, kicking down doors without due process, sending five year olds to detention centers and illegally deporting people to countries to which they have never ever been.”
With ICE’s fast developing technology, it has been relying on expedited removals to illegally deport hundreds of thousands of people at a speed quick enough to ship people out of the country before they have access to a full immigration court hearing.
The checks of authority of immigration officers has significantly decreased over the years, essentially allowing a low-level officer to act as both the prosecutor and judge with the process usually containing a single short interview without the time or opportunity to gather evidence or an attorney. By the time a proper case can be made, the person is already out of U.S. jurisdiction and can no longer fight in court. This allows many U.S. citizens, temporary visa holders and asylum seekers to be wrongly sent away. This completely dismisses habeas corpus and is an outright infringement of our rights.
ICE also goes against many amendments under the constitution:
-4th Amendment: protection against unlawful search and seizure
-5th Amendment: no person can be deprived of liberty without due process of law
-6th amendment (we’re on a role): criminal defendants have a right to an attorney
-14th Amendment: the right to due process and equal protection
And with ICE targeting specific demographics, we see terrorization of marginalized groups. According to Cato Institute, 90% of the arrested demographic have hispanic or latino heritage with most of those targeted being random street arrests of people with no criminal affiliation or arrest history. This is direct evidence of racial profiling. What happened to the “All men are created equal” clause? Why should I as a citizen be more afraid of deportation as a person of hispanic heritage then someone of a different demographic with real illegal gang affiliation? In what world is that equal?
With ICE illegally searching homes, detaining without real reason, dismissing accessibility to immigration court and targeting certain people of color, we don’t see a fair and dutiful administration, we see a tyrannical administration. As Michael Perloff, senior staff attorney at the ACLU D.C., said,“ICE should not, and legally cannot, create its own special exemption from the Constitution.”
DOGE

Next up is DOGE, and I am not talking about the cute dog meme – I am talking about the Department of Government Efficiency, another Trump Administration attempt to save tax dollars and formerly run by his advisor, Elon Musk, the man who makes your smart cars. DOGE claims “to cut federal spending, reduce bureaucracy, and modernize government technology.”
DOGE consists of mostly white males in their 20s whose job is to reduce federal spending. After an extensive study by ProPublica, it was concluded that 83% of DOGE employees were male (whereas the entirety of the executive branch is 54%) with over 60% of this department being in their 20s. Since its formation, DOGE has been granted access to your sensitive government data in order to identify target areas of waste and fraud with at least one employee being reported of having edit access to the documents. In a federal court filing, DOGE and the Trump Administration had admitted that DOGE not only tapped into the Social Security Administration’s database with your information in it, but they copied the data, sold that data, and signed an agreement with an outside political advocacy group that has intent of overturning election results.
Additionally, a DOGE employee, Justin Fox who committed fraud on his professional resume and was hired by DOGE through family networking, was previously found using CHATGPT, an artificial intelligence chatbot, to defund “Diversity, Equity, and Inclusion” (DEI) grants. In his most recent deposition in March, he was also seen as not having an understanding of what DEI is. He had claimed that it is discriminatory to educate on specific groups and claimed that a documentary on holocaust survivors “is a gender-based story that’s inherently discriminatory to focus on this specific group.”
The Trump administration has reported that DOGE has fired around 300,000 federal employees in what was deemed a randomized frenzy. “What DOGE did is it cut so big and so deep and so randomly that when the cabinet secretaries came in, and Elon Musk was gone, they realized that they had to bring some of these people back,” Elaine Kamarck, at the Brookings Institution think tank said. This was in an effort to change the federal deficit from $2 trillion dollars to close to zero (the amount federal spending exceeds revenue). Former DOGE employee Nathan Cavanaugh admitted that even with all the peoples lives who were upended by these firing, the federal deficit ultimately did not decrease.
Granted by the constitution, we have an implied right to privacy, and this is being upended by money hungry people in power who are stripping away your sensitive information for visibly no greater benefit to the country. By giving these people the power to upend our lives, we are giving up our rights as the people of America – this must be stopped.
Save Act
The Save Act, is a new act that changes voting by requiring a new added documentation for voters, which effectively eliminates the online easy registration voting process that has been working fine for the last couple of years.
Its goal?
To reduce non-citizen voting and ensure only U.S citizens vote in federal elections. Sounds harmless? Yes, until you realize proof of citizenship is not something that can be shown without a passport or a birth certificate – documents not everyone is able to use because circumstances exist. “An estimated 69 million American women have changed their last name due to marriage,” stated by igcimpact.org. “That means many eligible voters may have a birth certificate in one name and a current legal identity in another.”
This mismatch makes things complicated. This means that many people are now pushed to provide extra documents such as a marriage certificate or name-change document. But many people, like married women, no longer have access or the capability to locate these documents from years ago. What’s the easiest document to provide? A passport. A passport that millions of people don’t have because of the $130 it requires. In an article published by Brennan Center for Justice, research was done to identify the forms of identification citizens possessed. About “140 to 146 million Americans—nearly half of the U.S. population— do not have a valid passport.” The study found that “while many simply do not travel internationally, research indicate[ed] that over 21 million adult citizens face strict financial, bureaucratic, or logistical barriers (such as lost records) that prevent them from accessing passports or other foundational proof of citizenship.”
This is a real problem, if people are unable to vote because they cannot afford to possess identification – this emulsifies a poll tax, a tax on voting – which goes against the twenty-fourth amendment: “The right of citizens of the United States to vote in any primary or other election… shall not be denied or abridged… by reason of failure to pay any poll tax or other tax.”
Not only that, but it goes against the equal protection clause by giving certain groups an advantage over others, and excluding lower-income families, women, and people of color – again, we cannot claim an “all men are equal” stance when all men are in fact not equal.
People are losing their right to vote left and right without anyone to stand against it much like the grandfather clause, Jim Crow laws, poll taxes, and the literacy tests that were made in the past specifically to stop certain demographics from voting. This is a direct attack to our rights, our amendments, and our constitution, and if we let something that seems as trivial as a passport fee pass. What will they pass next?
War on Iran
Everyone has heard of the current war on Iran as of late, with the Trump administration becoming entangled in Middle Eastern affairs. This is the reason gas, food and normal basic necessities have gone up and our economy has plummeted. With Trump stopping passage to the Strait of Hormuz with this war, oil passage is stopped, as well as fertilizers and other important necessities that are needed globally by nations such as China and India. HormuzMoniter has stated that 17 and 21 million barrels of petroleum liquids per day pass through there— that represents approximately one-fifth of all the oil consumed by humanity.
Unauthorized by congress, the war has been led by the Trump Administration under the name of “Major Combat Operation” — As the president of the United States, Trump does not have legal authority to declare war. This is explicitly stated in article I section 8 of the constitution: “the Congress shall have Power… to raise and support Armies… to provide and maintain a Navy… to declare War.” This explicitly states that the power to declare war shall only be vested by congress, the legislative branch of government.
While the war powers resolution of 1973 allows the president to take action, he must first brief and update congress. Without this occurring, the president must withdraw troops within 60 days. Executive authority may only be made if the U.S was attacked first: As of now, no evidence can be provided of Iran attacking the U.S first – and no case was made to congress either. Trump exaggerated the risks that Iran imposed on the United States which would be non-existent if we did not continually support and get involved with Israel’s efforts to bomb the country. The people do not want an endless war in the Middle East. This is completely unauthorized by congress and abundantly unconstitutional.
There was a hearing in Washington to limit the Trump administration’s executive powers to strike on Iran, but this was all in all a completely illegal action that should result in impeachment. These miscalculations of Iran relations have led to the deaths of multiple U.S personnel. This is no longer America first, this is Israel first. I want to make it clear this is not a biased attack on Israel, but a commentary on the actions taken by the United States. As of right now, we are solely the problem by supporting a war that should not have any involvement with us. We are continuously suffering as a people because of our involvement in foreign affairs and this unconstitutionality must be put to a halt.
Message to Mr. Donald, stop bypassing the laws engraved by the people, for we are all suffering as a consequence.
What Can We Take From This?
We will always be American — whether the country wants us, whether we want it, whether the values of the founding fathers still stand to the values of today. As a part of the American people, we have a duty to stand up for our rights and remain adherent to our constitutionality for it is what has made us.
Once, a long time ago, we claimed equality but kept the enslaved, claimed fairness but leveraged the rich, claimed rights for all when the all was but a few.
By leveraging and bending the rules of our country, we completely bypass the standards for which the revolution was fought and fall back into the tyrannical rule of the 1600s. We must move forward as a people, and in doing so, we move forward as a whole.
