User Agreement

These Terms of Use constitute an agreement between you and the WriteBoston Team (“WriteBoston,” “we,” or “us”) that governs your use of writeboston.org and all associated services and websites, including but not limited to bostontip.com (“Teens in Print”) and hub.teensinprint.com (“Writing through the Distance”). These Terms of Use include any content, functionality and services offered on or through writeboston.org, bostontip.com, and hub.teensinprint.com (collectively, the “Websites”). Please read the Terms of Use carefully. By using the Websites, you affirm that you have read, understood, and accepted the terms and conditions in the Terms of Use. If you do not agree with any of these conditions, please do not use the Websites.

Your privacy is important to us. Please read our Privacy Policy, which identifies how we use, collect, and store information we collect through the Websites. By using the Websites, you additionally agree that you are comfortable with WriteBoston’s Privacy Policy.

The Websites are open to adults and children of all ages, and we ask that you keep this in mind when using the Websites. 

WriteBoston may change the Terms of Use from time to time. You can always find the latest version of the Terms of Use at https://writeboston.org/termsofuse. The date of the most recent revisions will appear on this page. Your continued use of the Websites constitutes your acceptance of any changes to or revisions of the Terms of Use.

Accessing the Website

We reserve the right to withdraw or amend any of the Websites, and any service or material we provide on the Websites. We will not be liable if for any reason all or any part of the Websites are unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Websites, or the entirety of one or more of the Websites.

You are responsible for ensuring that all persons who access the Websites through your internet connection are aware of the Terms of Use and our Privacy Policy and comply with them.

Intellectual Property Rights

WriteBoston owns and retains all rights in all content on the Websites created by us, including the design of the Websites and any other WriteBoston materials.

WriteBoston publishes written and other artistic works created by Boston students. The creator(s) of each of these works is the owner(s) of that work and retains all legal rights with respect to that work. By submitting content to WriteBoston, you (the owner) agree to grant to WriteBoston and its affiliates, employees, agents, and assignees a worldwide, non-exclusive, royalty-free license to use (including to reproduce, distribute, and display) the content on any of our Websites or in any other WriteBoston publication. If you wish to remove your content from the Websites, please contact us at https://writeboston.org/contact-us.

When you submit content to WriteBoston, you (the owner) also agree:

  • That WriteBoston can screen and edit your work prior to our using it. 
  • That you have cited all sources.
  • That you are not promoting or advertising any product.
  • That your work does not harass, defame, abuse, or bully anyone else, and does not otherwise violate the law.
  • That you are not violating the privacy of anyone else by providing any information that is private and non-public.
  • That you have the right to use all the content you submit, including any attachments such as pictures provided with the content.

These Terms of Use permit visitors to the Websites to use the Websites for personal, non-commercial use only. Anyone interested in sharing student work published on the Websites may share a link anywhere they see fit. Additionally, teachers and other instructional providers interested in providing annotations or scaffolding for their students may copy and paste article content into a Google Doc or another privately-hosted platform. Educators should not repost our content onto class websites, social media, or any other public online platforms. Non-educators interested in copying content from our website to distribute elsewhere, whether privately or publicly-hosted, must contact us via the form on the site where they found the student content to request permission. For inquiries about any other use of content on the Websites, please contact WriteBoston at https://writeboston.org/contact-us. 

The WriteBoston name, WriteBoston logo, Teens in Print name, Teens in Print logo, Writing through the Distance name, and Writing through the Distance logo, are Trademarks owned by WriteBoston. Unless you are the owner of a license by WriteBoston under a specific licensing program or agreement, you may not use these logos to label, promote, or endorse any product or service. You may use the WriteBoston logo to refer to the WriteBoston website and associated Websites.

Prohibited Uses

You may use the Websites only for lawful purposes and in accordance with these Terms of Use. You agree not to use the website:

  • In any way that violates federal, state, local or international law.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To impersonate or attempt to impersonate WriteBoston, a WriteBoston employee, or any other person or entity.
  • To engage in any other conduct that restricts anyone’s use or enjoyment of the Websites, or which may harm WriteBoston, its users, or its Websites and other services.

 

Digital Millenium Copyright Act (DMCA)

If you are a copyright holder and believe content on the Websites violates your rights, you may send a DMCA notification to https://writeboston.org/contact-us. For more information, including the information that must be included in a DMCA notification, see our full DMCA Policy and the text of the DMCA, 17 U.S.C. § 512.

If you are a WriteBoston contributor and you believe that your content did not constitute a copyright violation and was taken down in error, you may send a notification to https://writeboston.org/contact-us. Please include:

  • The specific content you believe was taken down in error
  • A brief statement of why you believe there was no copyright violation (e.g., the content was not copyrighted, you had permission to use the content, or your use of the content was a “fair use”).

Third Party Websites

Content on the Websites may include links to third party websites. WriteBoston is not capable of reviewing or managing third party websites, and assumes no responsibility for the privacy practices, content, or functionality of third party websites. You agree to relieve WriteBoston of any and all liability arising from third party websites.

Indemnification

You agree to indemnify WriteBoston and all of its affiliates, employees, staff writers, agents, representatives, third party service providers, and members of their governing boards (all of which are “WriteBoston Entities”), and to defend and hold each of them harmless, from any and all claims and liabilities (including attorney’s fees) arising out of or related to your breach of the Terms of Service or your use of the Websites.

For federal government agencies, provisions in the Terms of Use relating to Indemnification shall not apply to your Official Use, except to the extent expressly authorized by federal law. For state and local agencies in the United States, Terms of Use relating to Indemnification shall apply to your Official Use only to the extent authorized by the laws of your jurisdiction.

Changes to the Websites

We may update the content on the Websites from time to time, but the content is not necessarily complete or up-to-date. Any of the material on the Websites may be out of date at any given time, and we are under no obligation to update such material.

Online Donations and Purchases

WriteBoston, Inc. is a Nonprofit Corporation. We accept and rely on donations, and we have links on our Websites to donate. For details about what third party services we use, and what details we collect from donors, please refer to our Privacy Policy.

Disclaimer of Warranty

You acknowledge that you are using the Websites at your own risk. WriteBoston is provided “as is,” and the WriteBoston entities hereby expressly disclaim any and all warranties, express and implied, including by not limited to any warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a particular purpose or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form, including but not limited to the accuracy or completeness of any information contained therein or provided by WriteBoston. Without limiting the foregoing, the WriteBoston entities disclaim any and all warranties, express and implied, regarding any content published on the Websites. The WriteBoston Entities and their third party service providers do not represent or warrant that access to the Websites will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted through WriteBoston services.

Limitation of Liability

The WriteBoston entities shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages of any kind, regardless of the type of claim or the nature of the cause of action, even if the WriteBoston Team has been advised of the possibility of such damages. Without limiting the foregoing, the WriteBoston Entities shall have no liability to you or any third parties for damages or harms arising out of content published on or contained in the Websites.

Jurisdiction

WriteBoston is offered by the WriteBoston Team from its facilities in the United States. We make no representations that the Websites are appropriate or available for use in other locations. Those who access or use the Websites are responsible for compliance with local law.

Choice of Law and Venue

You agree that these Terms of Use, for all purposes, shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts applicable to contracts to be wholly performed therein, and any action based on, relating to, or alleging a breach of the Terms of Use must be brought in a state or federal court in Suffolk County, Massachusetts. In addition, both parties agree to submit to the exclusive personal jurisdiction and venue of such courts.

If you are a federal, state, or local government entity in the United States using WriteBoston in your official capacity and legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you. For such U.S. federal government entities, these Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in absence of federal law and to the extent permitted under federal law, the laws of the Commonwealth of Massachusetts (excluding choice of law).

Choice of Language

If the WriteBoston Team provides you with a translation of the English language version of these Terms of Use, the Privacy Policy, or any other policy, then you agree that the translation is provided for information purposes only and does not modify the English language version. In the event of a conflict between a translation and the English version, the English version will govern.

Waiver and Severability

No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and the WriteBoston Team’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

 

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

This document, together with our Privacy Policy and DMCA policy, constitutes the entire agreement between you and WriteBoston relating to the use of the Websites, and supersedes all previous agreements with the WriteBoston Team.
